10th Amendment, U.S. Constitution: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people."
The absence of "explicit rights" from the Constitution is a cynical canard fabricated by proto-fascists, such as Robert Bork's Federalist Society, to legitimate their never-ending grab for authoritarian control of this nation and the world. The 10th Amendment states explicitly that any "power" not abridged by the Constitution, belongs to the people.
